These Terms & Conditions apply to photography services provided by Loida Camats Quer, trading as Loida Quer ("Loida Quer", "the business" or "the photographer").

By booking or commissioning photography services, the client agrees to these Terms & Conditions.

1. Services

Photography services may include, but are not limited to:

  • Portrait photography;

  • Environmental and documentary photography;

  • Photography for cultural and artistic events;

  • Photography for businesses and organisations;

  • Visual content creation;

  • Other photography services agreed between the parties.

The specific services, scope of work, deliverables, pricing and deadlines for each assignment will be agreed with the client before the work begins.

2. Booking and confirmation

A booking or assignment is considered confirmed once the scope of work and relevant terms have been agreed between the client and the photographer.

Depending on the assignment, a deposit or advance payment may be required to confirm the booking.

The photographer reserves the right to decline an assignment where the requested work falls outside the available services, availability, expertise or professional boundaries.

3. Pricing and payment

Prices and payment terms will be agreed with the client before the assignment begins.

Unless otherwise agreed in writing:

  • Invoices must be paid by the due date stated on the invoice;

  • The client is responsible for providing accurate billing information;

  • Additional services or expenses outside the agreed scope may be charged separately.

Any applicable taxes or VAT will be handled in accordance with Norwegian law and the applicable tax status of the business.

4. Deposits and advance payments

Where a deposit or advance payment is required, the amount and payment terms will be communicated before booking.

The treatment of deposits and advance payments in the event of cancellation will depend on the circumstances and the specific terms agreed for the assignment, subject to applicable law.

5. Cancellation and rescheduling

If a photography session or assignment needs to be cancelled or rescheduled, the photographer should be contacted as soon as possible.

Rescheduling is subject to availability.

Cancellation fees, refund terms or loss of deposits may apply depending on the type of service, the timing of the cancellation and the specific terms agreed for the assignment.

Any cancellation rights that cannot legally be excluded will remain unaffected.

6. Client responsibilities

The client is responsible for:

  • Providing accurate information relevant to the assignment;

  • Communicating specific requirements or limitations in advance;

  • Obtaining any necessary permissions for locations, venues or participants where applicable;

  • Ensuring that the agreed location is reasonably suitable for the planned photography;

  • Informing the photographer of circumstances that may materially affect the assignment.

For commercial assignments, the client is responsible for ensuring that all necessary rights and permissions have been obtained for any materials, logos, trademarks or other content supplied to the photographer.

7. Artistic style and creative discretion

Photography is a creative service.

Unless specific requirements have been agreed in writing, the photographer retains reasonable creative discretion over:

  • Composition;

  • Lighting;

  • Photography style;

  • Image selection;

  • Editing and colour grading;

  • Final artistic presentation.

The photographer's portfolio represents the general photographic style offered, but final images may vary according to location, lighting, subject, weather and other circumstances.

8. Delivery of photographs

The agreed delivery method and estimated delivery timeframe will be communicated before or during the assignment.

Unless otherwise agreed, final photographs will be delivered digitally.

The client is responsible for downloading and safely storing delivered files.

The photographer may retain copies of delivered photographs for archival purposes but does not guarantee permanent storage of client files.

9. Editing and image selection

The final selection and editing of photographs will be carried out according to the photographer's professional and artistic judgement unless otherwise agreed.

Unless explicitly included in the agreed service, clients are not entitled to:

  • Unedited RAW files;

  • Unselected photographs;

  • Unedited or unfinished images.

Requests for additional editing or substantial revisions may be subject to an additional fee.

10. Copyright and intellectual property

Unless otherwise agreed in writing, copyright and intellectual property rights in photographs created by the photographer remain with the photographer.

The client does not acquire ownership of copyright by purchasing photography services or receiving digital image files.

Any transfer of copyright must be expressly agreed in writing.

11. Client licence and permitted use

Unless otherwise agreed, the client receives a non-exclusive, non-transferable licence to use the final delivered photographs for the purposes agreed at the time of booking.

Permitted use may include personal use and, where agreed, specific commercial or promotional use.

Without prior written permission from the photographer, the client may not:

  • Sell or sublicense the photographs;

  • Transfer the photographs to third parties for unrelated commercial use;

  • Claim authorship of the photographs;

  • Make substantial alterations to the photographs;

  • Use the photographs in a misleading or defamatory manner;

  • Use the photographs outside the agreed licence.

For commercial assignments, permitted usage rights will be determined by the specific agreement with the client.

12. Photographer's portfolio and promotional use

Photographs created during an assignment may be used for the photographer's professional portfolio, website, social media, exhibitions, competitions, publications or other promotional purposes where an appropriate legal basis or permission exists.

Identifiable photographs of individuals will only be published where there is an appropriate legal basis or permission to do so, taking into account applicable privacy and data protection laws.

Where the client or another person has specifically requested that identifiable images not be used publicly, such requests will be respected where agreed and where legally applicable.

For commercial assignments, confidentiality or publication restrictions should be agreed in writing before the assignment begins.

13. Privacy and personal data

Personal data is processed in accordance with the Privacy Policy and applicable data protection law.

14. Force majeure

The photographer will not be considered responsible for failure or delay in performing an assignment where this is caused by circumstances beyond reasonable control.

Such circumstances may include, but are not limited to:

  • Serious illness or injury;

  • Accident;

  • Extreme weather;

  • Natural disasters;

  • Government restrictions;

  • Transport disruptions;

  • Venue closure;

  • Technical failures beyond reasonable control;

  • Other unforeseen circumstances that make performance impossible or unreasonable.

Where possible, the client will be informed as soon as reasonably practicable and an appropriate solution will be sought, which may include rescheduling.

15. Technical failure, loss or damage

Reasonable technical and organisational measures are taken to protect and back up photographic files.

However, in the unlikely event of technical failure, data corruption, equipment failure or loss of files despite reasonable precautions, liability will be limited to the remedies available under applicable law and, where appropriate, the amount paid for the affected photography service.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

16. Liability

Photography services will be provided with reasonable care and professional skill.

The photographer will not be liable for losses arising from circumstances outside reasonable control or from the client's failure to provide necessary information, permissions or cooperation.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.

17. Complaints

Concerns regarding a photography service should be communicated as soon as possible so that the matter can be reviewed and a reasonable solution can be considered.

18. Changes to these Terms & Conditions

These Terms & Conditions may be updated from time to time.

The version applicable to a specific assignment will generally be the version in effect when the booking or assignment is confirmed, unless otherwise agreed.

19. Governing law

These Terms & Conditions are governed by the laws of Norway, unless mandatory provisions of applicable law provide otherwise.

Any disputes will be handled by the competent courts in accordance with applicable Norwegian law and mandatory jurisdiction rules.
